Welcome to the TapMe Privacy Policy

When you use TapMe's services, you trust us with your information. This Privacy Policy is meant to help you understand what data we collect, why we collect it and what we do with it. This is important; we hope you will take time to read it carefully.

Privacy Policy

TapMe aims to roll out an ever increasing number of services to retailers and their customers and other users of TapMe. Any information that is shared with us enables to make those services better - to show you more relevant offers, to help you save money or to make your use of our services quicker and easier. We want you to be clear how we’re using information and the ways in which you can protect your privacy.

Our Privacy Policy explains:

  • What information we collect and why we collect it.
  • How we use that information.
  • The choices we offer, including how to access and update information.

We’ve tried to keep it as simple as possible, but if you’re not familiar with terms, such as cookies, IP addresses, pixel tags and browsers, then read about these key terms first. Your privacy matters to TapMe, so please do take the time to get to know our practices – and if you have any questions, contact us.

Information that we collect

We collect information to provide better services to all of our users – such as when you like to visit your favourite retailer, or which offers you'll find most useful.

We collect information in the following ways:

  • Information you give us. For example, many of our services require you to join TapMe. When you do, we’ll ask for personal information, like your name, email address, telephone number or credit card to store with your account.

  • Information we get from your use of our services. We collect information about the services that you use and how you use them, like when you visit a retailer, or if you redeemed an offer.

    This information includes:

    • Log information

      When you use our services or view content provided by TapMe, we automatically collect and store certain information. This includes:

      • details of how you used our service, such as where and when you earned a loyalty point.

      • Internet Protocol Address.

      • device event information, such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL.

      • cookies that may uniquely identify your browser or your TapMe Account.

    • Location information

      When you use TapMe services, we may collect and process information about your actual or presumed location. We use various technologies to determine location e.g. GPS

    • Unique application numbers

      Certain services include a unique number. This number may be sent to TapMe when you interact with a TapMe retailer or service.

    • Local storage

      We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage and application data caches.

    • Cookies and similar technologies

      We use various technologies to collect and store information when you visit a TapMe service, and this may include using cookies or similar technologies to identify your browser or device.

Information we collect when you are signed in to TapMe, in addition to information we obtain about you from retailers using our services, may be associated with your TapMe Account. When information is associated with your TapMe Account, we treat it as personal information. For more information about how you can access, manage or delete information that is associated with your TapMe Account, visit the Transparency section of this policy.

How we use information that we collect

We use the information we collect from all of our services to provide, maintain, protect and improve them, to develop new ones and to protect TapMe and our users. We also use this information to offer you tailored content – like giving you more relevant offers, notifications, and communications. When showing you tailored ads, we will not associate an identifier from cookies or similar technologies with sensitive categories, such as those based on race, religion, sexual orientation or health.

We may use the email address that you provide when you join TapMe to send you information about offers we think you may be interested in or more information about TapMe. We do not share this information with any of our retailers by default. We will ask for your consent before passing your email address or any other information to any retailers or third party services.

If you have joined TapMe using a Google Account, Facebook or any other identity service, we may display any Profile name or Profile photo you have authorised for use by TapMe in our services to our retailers.

When you contact TapMe, we keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.

We use information collected from cookies and other technologies, like pixel tags, to improve your user experience and the overall quality of our services. One of the products we use to do this is Google Analytics.

We may combine personal information provided to receive an offer from one retailer, including personal information, with information from other TapMe services – for example, to make it easier to share retailers you like with people you know.

We will ask for your consent before using information for a purpose other than those set out in this Privacy Policy. TapMe processes personal information on our servers in many countries around the world. We may process your personal information on a server located outside the country where you live.

Information that we share

We do not share personal information with companies, organisations and individuals outside of TapMe unless one of the following circumstances applies:

  • With your consent

    We will share personal information with companies, organisations or individuals outside TapMe when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information.

  • With TapMe retailer administrators

    If you have used your TapMe card at a retailer the retailer will be able to view statistics regarding your TapMe account related to your interaction with their services, such as statistics regarding when you have used their services etc.

  • For external processing

    We provide personal information to our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures.

  • For legal reasons

    We will share personal information with companies, organisations or individuals outside TapMe if we have a belief in good faith that access, use, preservation or disclosure of the information is reasonably necessary to:

    • meet any applicable law, regulation, legal process or enforceable governmental request.
    • enforce applicable Terms of Service, including investigation of potential violations.
    • detect, prevent or otherwise address fraud, security or technical issues.
    • protect against harm to the rights, property or safety of TapMe, our users or the public, as required or permitted by law.

We may share non-personally identifiable information publicly and with our partners – like publishers, advertisers or connected sites. For example, we may share information publicly to show trends about the general use of our services.

If TapMe is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Information security

We work hard to protect TapMe and our users from unauthorised access to or unauthorised alteration, disclosure or destruction of information that we hold. In particular:

  • We encrypt many of our services using TLS.
  • We review our information collection, storage and processing practices to guard against unauthorised access to systems.
  • We restrict access to personal information to TapMe employees, contractors and agents who need to know that information in order to process it for us and who are subject to strict contractual confidentiality obligations. They may be disciplined or their contract terminated if they fail to meet these obligations.

What are your data protection rights?

TapMe would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

  • The right to access – You have the right to request for copies of your personal data. We may charge you a small fee for this service.
  • The right to rectification – You have the right to request that TapMe correct any information you believe is inaccurate. You also have the right to request TapMe complete the information you believe is incomplete.
  • The right to erasure – You have the right to request that TapMe erase your personal data, under certain conditions.
  • The right to restrict processing – You have the right to request that TapMe restrict the processing of your personal data, under certain conditions.
  • The right to object to processing – You have the right to object to TapMe's processing of your personal data, under certain conditions.
  • The right to data portability – You have the right to request that TapMe transfer the data that we have collected to another organization, or directly to you, under certain conditions.

When this Privacy Policy applies

Our Privacy Policy applies to all of the services offered by TapMe and its affiliates, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.

Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, sites that may include TapMe services or other sites linked from our services. Our Privacy Policy does not cover the information practices of other companies and organisations that advertise our services and that may use cookies, pixel tags and other technologies to serve and offer relevant ads.

Compliance and cooperation with regulatory authorities

We regularly review our compliance with our Privacy Policy. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We will work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.

Changes

Our Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent. We will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes). We will also keep prior versions of this Privacy Policy in an archive for your review

TapMe Terms of Service For Customers

Who does this apply to?

This applies to anyone holding a TapMe card or other identity device e.g. a key fob. If you have been given a card by a gym, shop, or organisation then this agreement applies to you.

Agreement

This is an agreement between "TapMe", the owner and operator of www.tapme.app (Site), the TapMe app software ("TapMe App and TapMe Retailer App"), or the "Service", or "App" and you, a user of the Service. By using this service you agree to these Terms Of Service and the TapMe Privacy Policy. If you do not agree to any of these terms, you may not use the Service.

The Service

The App can used in conjunction with a customer identity to indicate attendance e.g. for a gym session, class or coaching session, or to build up loyalty points that can be used to redeem against a given Retailer Offer. Interaction with the App creates events such as TapMe In and TapMe Out, Points, Offers, Redemptions. These together with Customer details are processed through TapMe's codebase, messaging framework, and database.

You can view your points balance and available Rewards through TapMe email correspondence, by visiting a Retailer, via the TapMe website, or the TapMe Customer Mobile App.

We will use our reasonable endeavors to make the Service available to You at all times, but We cannot guarantee an uninterrupted or fault free service.

We reserve the right to make modifications to the existing Service by adding, removing or updating features as we deem necessary in order to provide the best possible service to you.

Access to the Service

By using the Service, you agree to the following:

  • You will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without TapMe's prior authorization
  • You will not attempt to reverse engineer, alter or modify any part of the Service
  • In order to access and use the features of the Service, you acknowledge and agree that you will have to present the App with either your TapMe card, or TapMe card number.
  • You may never use another person's TapMe card or card number without their consent.
  • When providing personal information you agree to provide accurate and verifiable data.

Cancellation

If you decide that you no longer wish for TapMe or the TapMe Retailers you have visited to hold your information (such as visits, rewards or any other stored personal data) you can do so by emailing TapMe: [email protected]

Termination by TapMe

In the event that We, in our sole discretion, consider that you are making any illegal and/or unauthorised use of the Service, and/or your use of the Service is in breach of these Terms, we reserve the right to take any action that it deems necessary, including terminating without notice your use of the Service and, in the case of illegal use, instigating legal proceedings.

Intellectual property rights

TapMe are the owner or the licensee of all intellectual property rights (including copyright and trade marks, in our Service. The contents on our Site and App including their look and feel are protected by copyright law. All such rights are reserved by us.

You must not use any part of the content on our Site or App, for commercial purposes without obtaining a licence to do.

Our warranties

Whilst TapMe endeavours to provide a Service that is always available, this may not always be the case and in this instance TapMe cannot be held liable for any loss that may be incurred.

TapMe accepts no responsibility or liability for claims against Retailers from customers. TapMe neither excludes nor limits its liability for death or personal injury caused by its own negligence or any other liability the exclusion or limitation of which is expressly prohibited by law.

TapMe is not obliged or liable for any loss incurred by a Retailer for wrongful use of the Service, such as rewarding customers or giving out points by accident.

Changes to these terms

We may revise these Terms of Service at any time by amending this or subsequent pages.

Please check this and subsequent pages from time to time to take notice of any changes we made, as they are binding on you. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

TapMe Terms of Service For Retailers

Who does this apply to?

This applies to a TapMe Retailer. A TapMe Retailer is a person or organisation, e.g. club or company that uses TapMe to provide services to its own organisation, employees, or customers (Customer).

Agreement

This is an agreement between "TapMe", the owner and operator of www.tapme.app (Site), the TapMe app software ("TapMe App and TapMe Retailer App"), or the "Service", or "App" and uou, a person or organisation using the Service. By using this service you agree to these Terms Of Service and the TapMe Privacy Policy. If you do not agree to any of these terms, you may not use the Service.

The Service

The App can used in conjunction with a customer identity to indicate attendance e.g. for a gym session, class or coaching session, or to build up loyalty points that can be used to redeem against a given Retailer Offer. Interaction with the App creates events such as TapMe In and TapMe Out, Points, Offers, Redemptions. These together with Customer details are processed through TapMe's codebase, messaging framework, and database.

You can view certain Customer activities, e.g. when they last visited your location, and manage certain settings and features via the App and the Site.

We will use our reasonable endeavors to make the Service available to You at all times, but We cannot guarantee an uninterrupted or fault free service.

We reserve the right to make modifications to the existing Service by adding, removing or updating features as we deem necessary in order to provide the best possible service to you.

Should at any time TapMe or the Service be anticipated to cease to exist we will endeavour to give you 3 months in advance notifcationto ceasation of all Services and this agreement with You. At the point of notification we will enter a closing down phase and will endeavour to continue to provide the service as best as possible and so that we can obtain Customer consent to transfer data to You.

Access to the Service

By using the Service, you agree to the following:

  • You will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without TapMe's prior authorization
  • You will not attempt to reverse engineer, alter or modify any part of the Service
  • In order to access and use the features of the Service, you acknowledge and agree that you will have to present the App with either your TapMe card, or TapMe card number.
  • Once handed to a Customer any card or other customer identity device e.g key fob, becomes the property of the Customer. You may never use a Customer's TapMe card, any other identity device, or card number without their consent afterwards.
  • When providing personal information you agree to provide accurate and verifiable data.

Privacy of Customer data

The privacy and control of customer data by the Customer is very important to TapMe and we expect You to make every effort to protect your Customers' data when using TapMe.

You are responsible for gaining the consent of the Customer for any of their data that you add to the TapMe system which has not been obtained with TapMe consent. This can include data collected by Yourself in order to add a Customer's name and phone number to their contact details in the App if they have not 'joined' TapMe and supplied those details to TapMe themselves.

You will not share any Customer data with other parties without the explicit consent of the Customer.

You must abide by the laws and regulations of the country in which the data has been collected. For the U.K. You can find out your data responsibilities via the the Information Commissioner’s Office.

Termination by TapMe
